📢 Quick Guide: Can I get my residency papers in 2026?

If you are currently in Spain without legal status, the Government has announced an extraordinary regularization process for this year. Here is a clear, simple breakdown of everything you need to know:

1. Who can apply?

To enter this process, you must meet two basic requirements:

  1. Prior Residency in Spain: You must prove that you were already here before December 31, 2025. Additionally, you must have been in the country continuously for at least 5 months before submitting your application.
  2. Clean Criminal Record: You cannot have any legal issues (criminal records) in Spain or in your home country within the last 5 years.

2. Important Dates

  1. When can I apply? The application period is expected to open in April 2026.
  2. What is the deadline? You have until June 30, 2026. Don’t leave it until the last minute!

How long does it take? The Government has promised to reply within a maximum of 3 months. Furthermore, just 15 days after your application is officially admitted for processing, you will be able to start working.

3. What do I get if it’s approved?

You will receive a 1-year residency permit that allows you to work legally from day one. Furthermore, if you have minor children living with you in Spain, you can include them in the application so they can get their papers too.

4. What documents should I start collecting NOW?

Don't wait until April. Start preparing these today:

  1. Your Passport: Make sure it is not expired.
  2. The "Padrón": Go to your Town Hall and ask for the "Volante histórico de empadronamiento". This is the best proof of residence.
  3. Proof that you live here: Utility bills in your name, transport passes, money transfer receipts to your family, or medical records. Everything counts!
  4. Official Documents: If you were fined or applied for asylum in the past, keep those papers.
  5. Criminal Record Certificate: You will need to request this from your home country. Important: It must be valid (not expired) between April and June 2026, and it must be legalized or apostilled.
  6. For your children or spouse: Birth certificates, marriage certificates, and school enrollment certificates for the children.

🎒 Your Document "Backpack" (Checklist)

  1. Passport: Not expired (if it expires soon, renew it now!).
  2. Historical Padrón: This is the most important document. Request it at your Town Hall.
  3. Proof of "Daily Life": If you don’t have a Padrón, you can provide:
  4. Public transport monthly passes.
  5. Money transfer receipts (Western Union, locutorios, etc.).
  6. Doctor’s appointments or ER records.
  7. Shopping invoices/bills in your name.
  8. Essential: Criminal Record Certificate from your country (last 5 years). Remember it must be legalized or apostilled.
  9. Family: If you have children here, find their birth certificates and school certificates.
